GlobeOTA’s role is generally limited to facilitating discovery, booking, payment (where applicable), customer support, and related technology services.

4. Eligibility
To use the Platform, you must:

Customer means any individual or organization using the Platform to search for, enquire about, or purchase travel services.
Partner means any independent hotel, accommodation provider, activity operator, transportation provider, destination management company, or other supplier offering services through GlobeOTA.
Platform means the GlobeOTA website, applications, APIs, partner portal, and related services operated by Kilobyte Corporation Private Limited.
Travel Services means accommodations, transportation, activities, holiday packages, and other services made available through GlobeOTA.

* GlobeOTA does not guarantee the quality, safety, legality, suitability, or uninterrupted availability of services provided by independent partners.
* GlobeOTA is not responsible for acts or omissions of partners, except to the extent required by applicable law or where GlobeOTA has expressly assumed responsibility.
* The contractual relationship for the underlying travel service is generally between the customer and the relevant partner, while GlobeOTA provides the booking platform and related services.
Nothing in these Terms limits any rights available to consumers under applicable law.

10. User Registration
While certain sections of the Platform may be accessed without creating an account, some services require registration.

11. Mobile Number Verification
To protect users and reduce fraudulent activity, GlobeOTA may verify your mobile number using a One-Time Password (OTP).
By providing your mobile number, you consent to receiving OTPs and service-related communications necessary to complete registration, authenticate your account, or verify certain transactions.
Failure to complete verification may limit or prevent access to certain Platform features.

the individual creating the account represents and warrants that they have the authority to act on behalf of that entity or group.

17. Traveller Information
When making a booking for another person, you confirm that:
* You have obtained their permission to provide their information.
* The information provided is accurate.
* They have authorized you to act on their behalf regarding the booking.
* You have informed them that GlobeOTA will process their information in accordance with the Privacy Policy.
You are responsible for any errors in traveller information that result in booking issues or service disruptions.

18. Account Suspension
GlobeOTA may temporarily suspend access to an account where we reasonably believe that:
* Fraudulent activity has occurred.
* Unauthorized access is suspected.
* There is a security concern.

During suspension, access to certain services may be restricted until the matter is resolved.

* Harvest or scrape data without authorization.
* Manipulate reviews or ratings.
* Abuse promotional offers.
* Resell bookings without authorization.
* Infringe intellectual property rights.
* Transmit unlawful, defamatory, abusive, hateful, obscene, or offensive content.
Any such conduct may result in suspension or termination of your account and may be reported to the appropriate authorities where required.

You grant GlobeOTA a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, publish, and distribute such content for operating, promoting, and improving the Platform, subject to applicable law.
GlobeOTA reserves the right to moderate, edit, remove, or refuse to publish content that violates these Terms or applicable law.

28. Nature of Booking
A booking made through GlobeOTA constitutes your request to purchase travel services from the relevant partner.
A booking is generally considered confirmed only after:
* successful completion of applicable verification;
* successful payment (where required);
* acceptance by the partner (where applicable); and
* issuance of a Booking Confirmation by GlobeOTA.
Until confirmation is issued, availability is not guaranteed.

29. Availability
Availability displayed on the Platform is based on information provided by partners and may change without prior notice.
Although GlobeOTA strives to maintain real-time availability, there may be circumstances where:
* inventory changes before confirmation;

* a booking cannot be confirmed.
If a booking cannot be confirmed, GlobeOTA will make reasonable efforts to:
* offer suitable alternatives where available; or
* process an applicable refund in accordance with the Cancellation & Refund Policy.

* utility failures.
In such circumstances, GlobeOTA and the relevant partner will make reasonable efforts to assist customers, but availability of refunds, credits, rescheduling, or alternative arrangements will depend on the circumstances, partner policies, insurance coverage, and applicable law.

GlobeOTA acts primarily as a technology and marketplace platform facilitating bookings between customers and independent travel partners.
Unless expressly stated otherwise:
* GlobeOTA does not own or operate the listed accommodations, vehicles, or activities.
* GlobeOTA does not guarantee the quality, safety, or suitability of services provided by independent partners.
* GlobeOTA is responsible for operating the booking platform, processing payments where applicable, providing customer support, and facilitating communication and resolution between customers and partners.
Nothing in these Terms limits any statutory rights available to consumers under applicable law.

44. Responsibilities of Travel Partners
Each travel partner listed on GlobeOTA is solely responsible for the services they provide, including compliance with applicable laws and the accuracy of the information they publish.
Partners are responsible for:
* Maintaining valid licenses, registrations, permits, and approvals required by law.
* Providing services substantially as described on the Platform.
* Maintaining applicable health, hygiene, and safety standards.
* Honoring confirmed bookings, except where cancellation is permitted under the applicable booking terms or due to circumstances beyond reasonable control.
* Providing accurate pricing, availability, amenities, and service information.
* Complying with tax, consumer protection, tourism, and other applicable legal requirements.
* Maintaining valid insurance where required by law or appropriate for the services offered.
GlobeOTA may take appropriate action, including suspension or removal of listings, if a partner repeatedly fails to meet required standards or violates these Terms.

45. Customer Responsibilities During Travel
Customers are responsible for:
* Arriving at the property or service location on time.
* Carrying valid identification required by law or the partner.
* Complying with house rules and reasonable instructions issued by the partner.
* Respecting local customs, laws, and regulations.
* Maintaining appropriate behaviour toward staff, other guests, and local communities.
* Paying charges not included in the booking, where clearly disclosed.
* Taking reasonable care of personal belongings.
* Promptly reporting any issues encountered during the booking or service.
Customers remain responsible for the conduct of all travellers included in their booking.

46. Adventure Activities and Inherent Risks
Certain experiences available through GlobeOTA, including adventure or outdoor activities, involve inherent risks.
By participating in such activities, you acknowledge that:
* Participation is voluntary.
* You should ensure you meet any stated age, health, fitness, or safety requirements.
* You are responsible for following all safety instructions provided by the activity operator.
* Weather, terrain, wildlife, and other environmental conditions may affect the activity.
* Certain risks cannot be completely eliminated despite reasonable safety measures.
GlobeOTA facilitates bookings for these activities but does not operate them unless expressly stated otherwise. The activity provider is responsible for conducting the activity safely and in accordance with applicable law.
Nothing in this clause limits liability where GlobeOTA or a provider is responsible under applicable law.

47. Property Damage and Guest Conduct
Customers are responsible for any damage caused by themselves or members of their booking party to accommodation, vehicles, equipment, or other property.
Partners may recover reasonable costs for repair or replacement in accordance with applicable law and their published policies.
GlobeOTA may assist in facilitating communication between the parties but is not responsible for independently assessing or collecting damage claims unless expressly agreed.

48. Intellectual Property
All intellectual property rights relating to the Platform, including software, design, text, graphics, trademarks, logos, databases, images (except those owned by partners), and other content, are owned by or licensed to Kilobyte Corporation Private Limited.
Except as expressly permitted by law or with prior written consent, you must not:
* Copy or reproduce Platform content.
* Modify or create derivative works.
* Redistribute or commercially exploit content.
* Reverse engineer or decompile software.
* Use GlobeOTA trademarks or branding in a manner that suggests affiliation or endorsement.
Nothing in these Terms transfers ownership of GlobeOTA’s intellectual property to users or partners.

49. Feedback and Suggestions
If you provide suggestions, ideas, feedback, or recommendations regarding the Platform or our services, GlobeOTA may use them without restriction or obligation to compensate you, unless otherwise agreed in writing.

51. Limitation of Liability
To the extent permitted by applicable law, GlobeOTA shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use of the Platform or services provided by independent partners.
Where GlobeOTA is found liable for a direct loss resulting from its own breach of these Terms or applicable law, GlobeOTA’s liability shall be limited to the amount paid by the customer to GlobeOTA for the affected booking, unless a greater remedy is required by applicable law.
This limitation does not apply to liability that cannot be limited or excluded under applicable law, including liability arising from fraud, willful misconduct, or statutory consumer rights.

52. Indemnity
You agree to indemnify and hold harmless Kilobyte Corporation Private Limited, GlobeOTA, its directors, officers, employees, affiliates, and representatives from reasonable claims, losses, damages, liabilities, costs, and expenses arising from:

* your misuse of the Platform;
* your violation of applicable law;
* your infringement of third-party rights; or
* inaccurate information provided by you.
This obligation applies only to the extent permitted by applicable law.

Neither GlobeOTA nor its users shall be considered in breach of these Terms for delays or failures caused by events beyond their reasonable control, including:
* natural disasters;
* pandemics;
* epidemics;
* acts of government;
* war;
* terrorism;
* civil unrest;
* labour disputes;
* power failures;
* internet outages;
* failures of telecommunications infrastructure;
* transportation disruptions; or
* other unforeseen events beyond reasonable control.
Affected parties should take reasonable steps to mitigate the impact of such events where practicable.

55. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India.
Nothing in these Terms limits mandatory consumer rights available under applicable Indian law.

56. Dispute Resolution
If a dispute arises between you and GlobeOTA, both parties agree to first attempt to resolve the matter through good-faith discussions.
Customers are encouraged to contact GlobeOTA’s customer support team before initiating formal legal proceedings, as many issues can be resolved efficiently through our internal grievance process.

57. Arbitration
If a dispute cannot be resolved amicably and the parties agree to arbitration, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended.
Unless otherwise required by applicable law or mutually agreed:
* The seat and venue of arbitration shall be Jodhpur, Rajasthan, India.
* The arbitration shall be conducted in the English language.
* The arbitral award shall be final and binding on the parties.
Nothing in this clause prevents a consumer from exercising any rights or remedies available under applicable law where arbitration cannot lawfully restrict those rights.

GlobeOTA may provide notices to users through:

* in-platform notifications;
* WhatsApp (where the user has opted in);

Notices will be deemed delivered in accordance with applicable law and the communication method used.

GlobeOTA may assign or transfer its rights and obligations under these Terms to an affiliate, successor, or as part of a merger, acquisition, or business transfer, provided that such transfer does not reduce the protections available to users under applicable law.
